a Dublin transfer decision taken in respect of a family violates the International Convention on the Rights of the Child if the children have not been heard. Articles 3 and 12 of the Convention require that a request for implementation of the discretionary clause of the Dublin Regulation take account of the best interests of children, which the Committee on the Rights of the Child recalls that it must be a primary consideration. ; Une décision de transfert Dublin prise à l'égard d'une famille viole la Convention internationale relative aux droits de l'enfant si les enfants n'ont pas été entendus.
